(B) Our values and what this policy is for: We take your privacy very seriously and want to be accountable to you as well as transparent with you in the way that we collect and use your personal information. We endeavour to handle your personal information with care, keep it secure and comply with all relevant data protection laws.

  • financial information – information to enable us to ascertain your creditworthiness, your financial position (e.g. bank statements, evidence of employment wages, evidence sale of property etc), your bank account or other payment card details and assess the affordability of your gambling activity;
  • StableDuel account history – your betting track record and habits, and the history of your deposits and withdrawals into your StableDuel account;
  • interactions with us – our records of your discussions with our Support Team including customer service information and customer relationship management, such as call recordings, live call/chat history and related emails;

We will collect, use and store the personal information listed above to deal with any enquiries or issues you have about our products or orders you’ve placed with us, including any questions you may have about how we collect, store and use your personal information, or any requests made by you for a copy of the information we hold about you. If we do not have a contract with you, we may process your personal information for these purposes where it is in our legitimate interests for customer services purposes, for the carrying on of our business, or to meet our customer and future customer demand.

2.5 Whatever our relationship with you is, we may also collect, use and store your personal information for the following additional reasons:

(a) to deal with any enquiries or issues you have about how we collect, store and use your personal information, or any requests made by you for a copy of the information we hold about you. If we do not have a contract with you, we may process your personal information for these purposes where it is in our legitimate interests;

(b) for internal corporate reporting, business administration, ensuring adequate insurance coverage for our business, ensuring the security of company facilities, research and development, and to identify and implement business efficiencies. We may process your personal information for these purposes where it is in our legitimate interests to do so;

(c) to comply with any procedures, laws and regulations which apply to us – this may include where we reasonably consider it is in our legitimate interests or the legitimate interests of others to comply, as well as where we are legally required to do so; and/or

(d) to establish, exercise or defend our legal rights – this may include where we reasonably consider it is in our legitimate interests or the legitimate interests of others, to enforce our terms of use or other policies, as well as where we are legally required to do so.

We will not use your personal information in any way that is incompatible with the purposes set out in this section 2. 2.7 Aggregated and anonymous information

We may use your personal information and combine it with the personal information of others to identify trends and share or provide this trend information in an aggregated and anonymous form with third parties. For example, we may use information about your browsing habits as part of an aggregated number to identify which are our most popular website pages and products and services.

2.8 Using computers to make decisions about you

(a) We may carry out profiling of you and your activities in connection with our services so we can tailor marketing communications to better suit your interests. This will be based on the marketing selections you have made. Further information on our marketing activities and how you can opt out of receiving certain marketing is set out in section 9.

(b) In order to comply with our legal and regulatory obligations, we carry out automated and manual checks to identify and investigate any suspected unlawful, fraudulent or improper activity connected with our services, including possible money laundering, the use of proceeds of crime, and fraud. We also carry out checks in order to fulfil our safer gambling obligations. We use a third-party provider to carry out affordability checks, which are entirely automated, the results in respect of which determine financial thresholds that we apply to your account, including deposit and wager limits. The criteria used to assess affordability are based on aggregated demographic data which determine the relevant thresholds for each customer account.

2.9 Special categories of personal data

We may also process special categories of personal data about you or personal information relating to criminal offences committed by you, which may come directly from you, from other sources as described above or from decisions we have made about you. This information may include:

  • Health information – such as information about a gambling addiction or a specific vulnerability; and
  • Information relating to criminal offences – where we know or suspect a fraud, cheating, theft or other offence. This personal information is required to ensure we protect Your vital interests and/or defend legal claims.

3 Our legal basis for using your personal information

We consider that the legal bases for using your personal information set out in this privacy policy are as follows:

3.1 For contractual performance:

We shall process your personal information where it is necessary for us to carry out our obligations arising from any contracts we enter into with you, for example, to sell and provide you with our products and services, to fulfil an order which you place with us and/or to comply with the terms of use of our website which you accept by browsing our website.

3.2 Where we have your consent

We may process your personal information in some cases for marketing purposes on the basis of your consent (which you may withdraw at any time after giving it, as described below in section 9).

However, if you withdraw your consent, this may impact the ability for us to be able to provide products and services to you.

  • to provide products and services to our customers, make and receive payment and provide customer services;

  • to provide you with information from time to time including messages notifying you about changes to our website, services or changes to our terms and conditions, or to seek your feedback;
  • to provide you with employment opportunities, where you register for such updates, or make applications for a job with us on our website;

3.4 Where we have a legal or regulatory obligation

Both we and trusted third parties shall process your personal information where it is necessary for us to protect against, investigate, report and deter fraudulent, unauthorised or criminal activity connected with our services. This includes undertaking necessary security and identity verification checks, to ensure that we meet our regulatory obligations in respect of responsible gambling as an accountable organisation. Any such personal information may include special categories of personal data (such as health data relating to gambling addiction) and personal information relating to any unlawful activities, which we process to enable us to comply with any legal or regulatory requirements determined by our regulators (the Gambling Commission) or as set out in applicable laws and regulations.

4 Does StableDuel share your personal information

(a) with other StableDuel companies, where it is in our legitimate interests to do so for internal administrative purposes, primarily for compliance, audit and operational purposes, and also to run, grow and develop our business;

(b) with selected media partners and affiliates for the purposes of them being able to offer their own marketing services to you. We only do this where we have your consent and in line with your marketing preferences. You can opt-out of this at any time;

(c) where we engage the services of trusted third-party suppliers who provide us technical or operational support, with those suppliers and subcontractors, such as website hosting providers, cloud service providers (such as AWS), payment processors, utility providers, and insurers;

(d) with analytics and search engine providers that assist us in the improvement and optimisation of our website. For example, we may use Amplitude and Google Analytics to collect and process information about how the StableDuel website and App is used;

(e) with companies that assist in our marketing, advertising and promotional activities;

(f) we share your information with third-party suppliers such as credit reference agencies and suppliers of identity verification services to ensure we can comply with our legal and regulatory obligations including those relating to responsible gambling, anti-money laundering and fraud prevention requirements. Please note that credit reference agencies may keep a record of such information and disclose that information, and the fact that a search was made, for the purpose of legal and regulatory compliance and as part of their assessment of the risk of giving credit;

(g) if we are under a duty to disclose or share your personal information in order to comply with a legal obligation or any lawful request from government or law enforcement official and as may be required to meet national security or law enforcement requirements or prevent illegal activity this will include (among other circumstances), where we need to share your personal information with our regulators, such as the Gambling Commission, and other competent authorities, in order to comply with our legal or regulatory obligations;

(h) with necessary third parties to protect the rights, property, safety, or security of StableDuel, our staff, customers, third parties, visitors to our website or other persons. (j) if we undergo any reorganisation process, we may disclose your personal information to any prospective buyer of our business or assets; or, if substantially all of StableDuel’s or any of its affiliates’ assets are acquired by a third party, in which case all personal information held by StableDuel may be one of the transferred assets.

4.2 We take steps to ensure that our arrangements with third-party suppliers protect your privacy and impose privacy and security obligations consistent with this privacy policy and applicable laws. Any third parties with whom we share your personal information are limited (by law and by contract) in their ability to use your personal information for any purpose other than to provide services for us.

4.3 Save as expressly detailed above, we will never share, sell or rent any of your personal information to any third party without notifying you and, where necessary, obtaining your consent. If you have given your consent for us to use your personal information in a particular way, but later change your mind, you should contact us and we will stop doing so.

5 How long does StableDuel retain your personal information

5.1 Information that we collect will be retained only for as long as is necessary to fulfil the purposes outlined in this Policy or to comply with our legal and regulatory obligations. However, we may retain your information for a further period of time if specifically required by applicable law or regulation.

5.2 When determining the relevant retention periods for your personal information, we consider the following:

  • whether it is necessary for us to continue to process your personal information;
  • our contractual obligations and rights;

7.1 Some pages of our website and app use cookies, which are small text files placed on your internet browser when you visit our website, to offer you a full range of functions when you visit our website, recognise your preferences, and make your use of our website more comfortable and convenient for you.

7.2 Where we use cookies on our website, you may block these at any time. To do so, you can activate the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies), you may not be able be to access part of our website or to use all the functionality provided through our website. 8 How does StableDuel keep your personal information secure

8.1 We understand the importance of information security and the techniques needed to secure information. We use reasonable organisational, technical and administrative measures to protect your personal information from unauthorised access to or unauthorised alteration, disclosure or destruction of information that we hold and we take steps to ensure our subsidiaries, agents, affiliates and suppliers also employ adequate levels of security. In particular;

  • Secure Firewalled Datacentres;
  • Certified Encrypted Web pages; and
  • ISO27001:2013 certified business practices.

8.2 Although we make every effort to protect the personal information which you provide to us, the transmission of information over the internet is not completely secure. As such, you acknowledge and accept that we cannot guarantee the security of your personal information transmitted to our website and that any such transmission is at your own risk. Once we have received your personal information, we will use strict procedures and security features to prevent unauthorised access to it.
